[Opinion] State Compensation Lawsuits Regarding the Samcheong Re-education Camp Incident

◆ Will the State Be Held Liable for Post-Release Mental Illness and Death?

The Samcheong Re-education Camp incident—in which numerous citizens were detained without warrants and confined in military units under the pretext of "social purification" in 1980—continues to be the subject of state compensation lawsuits more than 40 years later.

Recently, a key issue has emerged regarding whether the scope of state liability extends beyond the direct harm caused by the initial illegal arrest, detention, or "re-education" (indoctrination) to include mental illnesses or deaths that occurred after the victims were released.

In particular, when a former detainee develops a mental illness after release, undergoes long-term treatment, and subsequently dies years later, the question arises as to the extent to which a causal link can be established between the state's past illegal acts and the resulting mental illness and death.

In its ruling (Case No. 2025Da212444) delivered on October 30, 2025, the Supreme Court established criteria for determining "proximate causation" in such cases.

◆ Death Five Years After Release Following Mental Illness: How Is Causation Determined?

The victim in this case was detained at the Samcheong Re-education Camp in 1980, underwent re-education, and was subsequently released. Prior to detention, the victim had engaged in normal social activities and enjoyed relatively good health; however, after release, they required repeated outpatient and inpatient treatment for mental illnesses, including schizophrenia.

The victim later died by suicide while admitted to a psychiatric care facility, prompting the bereaved family to file a claim for damages against the state. Approximately five years and six months had elapsed between the victim's release from the camp and their death. A key issue in the trial was whether a substantial causal link could be established between the victim's death and the mental illness resulting from the "re-education" (indoctrination) program at the Samcheong Re-education Camp.

The Supreme Court ruled that a substantial causal link between mental illness and death can be recognized if it can be reasonably inferred that: (1) the mental illness (such as schizophrenia) was caused by the state's unlawful acts; and (2) the suicide occurred while the victim was in a state of total loss of mental capacity or delirium, or in a state where their normal cognitive abilities, capacity to choose actions, and mental inhibitory controls were significantly impaired due to that mental illness.

◆ Cannot Judge Solely Based on the Passage of Time

The Supreme Court did not base its judgment solely on the time gap—specifically, the fact that the victim committed suicide approximately five and a half years after being discharged from the Samcheong Re-education Camp.

Instead, the Court considered several factors: the victim had engaged in normal social activities and enjoyed relatively good health prior to admission; despite receiving outpatient and inpatient treatment for mental illness after discharge, their condition did not appear to improve; and the suicide occurred while they were hospitalized in a psychiatric care facility.

The Court also took into account the fact that there was no discernible cause or motive for the suicide other than the mental illness.

Based on these circumstances, the Supreme Court determined there were grounds to infer that the mental illness was triggered by the Samcheong Re-education Camp program and that the suicide occurred while the victim's normal cognitive abilities and capacity to choose actions were significantly impaired due to that illness.

Consequently, the Court found that the lower court had erred in its interpretation of the legal principles regarding substantial causation by awarding only partial compensation for emotional distress; the case was therefore remanded for a retrial. ◆ Key Issues in the Case Handled by Jin & Sol: State Compensation Claims by Bereaved Families and the Statute of Limitations

When a victim has already passed away, issues may arise regarding not only the causal link to damages incurred after their discharge but also the statute of limitations during the bereaved family's process of claiming state compensation.

In a state compensation case concerning the Samcheong Re-education Camp handled by the Jin & Sol law firm, the victim's spouse and children filed a claim for damages against the Republic of Korea following the victim's death.

The victim in this case was confirmed to have undergone "re-education" (indoctrination training) at the Samcheong Re-education Camp for four weeks, from October 11 to November 8, 1980. After the victim subsequently passed away, the spouse and children filed a lawsuit against the state for damages.

A major point of contention in this case was the state's defense regarding the statute of limitations. The state argued that the short-term statute of limitations had expired, basing this claim on either November 1980—when the Samcheong re-education program ended—or December 2018, when the Supreme Court ruled that Martial Law Decree No. 13 was unconstitutional and void.

However, the court ruled that the starting point for the statute of limitations—defined as the "date on which the damage and the perpetrator became known"—refers to the date when the damage and the perpetrator were recognized in a realistic and concrete manner; merely speculating about the occurrence of damage or harboring doubts was deemed insufficient.

Furthermore, the court held that it was difficult to conclude that a social consensus existed at the time the re-education program ended recognizing the state's actions as unlawful. It also determined that the mere fact that Martial Law Decree No. 13 was later ruled unconstitutional and void was not enough to conclude that the victim or the bereaved family had realistically and concretely recognized the grounds for the state's liability for compensation. The court rejected the state's defense regarding the statute of limitations and ruled that 6 million won be paid to the spouse and 4 million won to the child, along with accrued interest for delayed payment.

◆ “If Harm Persisted After Discharge, Verification of Specific Evidence Is Required”

In state compensation lawsuits concerning the Samcheong Re-education Camp, it is necessary to examine not only the fact of forced internment but also how the harm sustained during that process impacted the victims' subsequent lives. This is particularly crucial in cases involving the onset of mental illness, prolonged treatment, or even death following discharge; one must carefully verify details such as pre-internment health and social life, the timing of the mental illness's onset, the course of outpatient and inpatient treatment, and the circumstances leading to death.

Kang Jeong-han, Managing Attorney at the law firm Jin & Sol, who handled the case, explained, “It is difficult to establish a link to the state's unlawful conduct based solely on the fact that mental illness or death occurred a significant time after discharge from the Samcheong Re-education Camp.” He added, “A comprehensive review of various factors is required, including health status before and after internment, the progression of mental illness and treatment, and living conditions at the time.”

He further advised, “Since a long time has passed, medical records or relevant materials from that era may be scarce; therefore, the process of specifically tracing the progression of the harm based on whatever medical and administrative records remain is vital.”

Attorney Kang Jeong-han, who provides legal services based in Changwon, Gyeongnam, emphasized that the harm caused by the Samcheong Re-education Camp was not an issue confined to any specific region. It is noted that while survivors and bereaved families who suffered after being forcibly interned in the Samcheong Re-education Camps likely still reside in the Gyeongnam region—including Changwon, Masan, and Gimhae—many may remain unaware of the possibility of filing claims for state compensation or the relevant procedures due to the long passage of time.

Attorney Kang Jeong-han of the law firm Jin & Sol expressed his commitment, stating, "The Samcheong Re-education Camp incident cannot be viewed merely as a matter of the past; given that both the victims and their families have endured suffering for so long, it is essential to thoroughly explore the potential for state compensation claims." He added, "As a lawyer based in Gyeongnam, I intend to continue helping victims and bereaved families in the region—including those in Changwon, Masan, and Gimhae—assert their rights and secure tangible remedies, such as state compensation for damages."
