이번 점검은 민선 7기 지방정부가 출범한 2018년 7월부터 지난해 12월까지 행동강령 규정 정비, 이해충돌방지 등 제도운영, 행동강령 위반사례 적발에 중점을 두고 있다.
실태조사 결과, 행동강령 규정 미비 등 다수의 보완사항과 부실한 제도운영 현황을 확인했다.
대통령령인 「공무원 행동강령」 및 「지방의회의원 행동강령」에 따르면, 지자체와 지방의회는 기관 특성에 적합한 기관별 자체 행동강령을 제정․운영해야 한다.
그러나 일부 지자체 행동강령에는 ▲직무권한 등을 행사한 부당 행위 금지 ▲감독기관의 부당한 요구 금지 규정 등이 누락됐다.
