[브레이크뉴스=이성용 기자] 지난 대선과 지방선거에서 윤석열 대통령과 박완수 경남지사, 홍남표 창원시장 등은 개발제한구역 해제에 관한 공약을 제시했다.

 

전면해제냐 부분해제냐 하는 차이는 있지만, 시민의 재산권 보호와 도시경쟁력 강화라는 점에서는 공통된 인식을 갖고, 공약을 한 것으로 보인다. 

 

하지만 탄소중립이나 기후위기 등에 대한 국민적 인식이 개선되면서 환경보호와 난개발 방지에 대한 사회적 공감대 형성과 기대심리가 작용한 측면도 있다. 

 

창원시 개발제한구역 주민연합회 회장단은 현재 창원지역 국회의원과 지방의원 등과 활발한 접촉을 벌이고 있다. 현 대통령과 도지사, 시장이 개발제한구역 해제를 공약으로 제시했음에도 이들이 분주하게 뛰어다니는 이유는 무엇일까.

 

부울경언론연대 소속 회원사 기자들이 신용찬 신임회장을 만나 창원시 개발제한구역 해제를 위한 공약추진 상황과 활동 배경 및 향후 활동계획, 개발제한구역 해제에 반대하는 환경단체 입장이나 시민 정서가 어떤지를 들어봤다. 

 

다음은 창원시 개발제한구역 주민연합회의 신용찬 회장과 부울경언론연대와 인터뷰 내용이다.

 

▲ 먼저 창원시 개발제한구역 현황에 대해...

 

창원시 전체면적의 33.2%가 그린벨트인데, 이는 지난 1973년부터 지금까지 50년 가까이 개발제한구역으로 묶여 있어 사소한 영농행위에도 과태료 처분을 받는 등 재산권 행사에 심각한 제약을 받고 있습니다.

개발제한구역이 아닌 임야에서는 지주가 임산물을 생산할 수 있습니다. 그런데 그린벨트 안에서는 돌멩이 하나 제대로 옮기지를 못하고 풀 한포기도 제대로 뽑아낼 수가 없습니다. 툭하면 벌금 내야하고 과태료 처분을 받게 됩니다.

 

마산회원구 사례를 보면 과거에 개발제한구역에서 해제된 대로변에서는 차량정비로 매연이 발생하고 환경오염을 유발시켜도 단속의 손길이 미치지 않습니다. 그런데 경계선에 있는 개발제한구역에는 컨테이너 설치도 불가능합니다. 농업휴식공간으로 강제철거되고 벌금이나 과태료 처분을 받기때문입니다.

 

심지어 진해구에서는 지난 8월에 80대 노인이 극단적인 선택을 한 경우도 있습니다. 연세가 많아 개발제한구역 안에 있는 다랭이논 70여평을 깎아 좀 편하게 농사를 지으려고 했던 것인데, 창원시에서는 형질변경이라며 원상복구 명령을 내렸습니다. 형사고발까지 당해 200만 원의 벌금형을 선고받았고, 1260만 원의 이행강제금까지 부과되면서 벌어진 일입니다.

 

이 밖에도 과도한 규제로 재산권을 침해받은 사례가 수없이 많지만, 개발제한구역이라는 족쇄에 갇혀 평생을 역차별당하며 살아가고 있는 사람들의 실정에 대해서도 정부나 지자체가 귀를 기울여달라는 것입니다.

 

▲ 개발제한구역 해제 필요성에 대해서는 공감이 가는 측면도 있지만, 기후위기의 심각성, 탄소중립 필요성은 창원시를 떠나 국정과제이기도 하고 세계적 현안이나 이슈입니다. 환영오염 촉진 우려에 대해서는 어떻게 생각하십니까?

 

현재 창원시 개발제한구역은 창원시 전체 면적의 33.2%를 차지하고 있습니다. 그 중의 약 88%가 임야이고, 가용할 수 있는 면적이라고 해봐야 11.2%에 불과합니다. 또 개발제한구역은 다른 토지와 다르게 등급이 1등급부터 5등급까지 나눠지는데 경사도가 높은 1,2등급 임야가 도시 외곽의 대부분을 차지하고 있습니다.

 

특히 임야는 산지관리법, 농지는 농지법, 대지는 건축법 등 모든 토지에는 상위법인 특별법과 함께 하위법률이 있습니다. 따라서 개발제한구역이 전면 해제된다고 해도 하위법률에 의해 다시 개발이 제한되기 때문에 난개발 우려나 환경에 미치는 악영향은 크게 문제가 되지 않습니다.

 

반면 지금은 지방소멸이 가속화되는 시기입니다. 창원시도 인구가 줄어들고 있습니다. 도시 발전을 통한 인구소멸, 지방소멸 문제를 해결해야 하는데 50년 간 묶여 있는 개발제한구역이 창원시 발전에 장애가 되고 있다는 것입니다.

 

▲ 생활 근거지를 도심 외곽으로 옮기거나 인근의 다른 도시로 이사를 하는 경우도 많습니다. 부동산 가격 상승이 이어진 탓도 있지만, 시민들이 보다 쾌적한 환경에서 살고 싶다는 욕구도 강하게 작용합니다. 그만큼 도시환경이 인구유출이나 유입에 적잖은 영향을 미친다고 보는데요.

 

현재 창원시 도시 계획은 도심 안은 개발제한구역으로 묶어놓고 북면이나 다른 외곽으로 주거지를 옮기고 있는 상황입니다. 그렇게되면 불필요한 기반시설을 더 갖춰야 하고 출퇴근 거리가 길어지면서 자동차 탄소배출량도 그만큼 많아질 수밖에 없습니다. 탄소중립 정책에 역행한다는 것입니다.

 

더욱이 창원시는 도심 주변을 임야가 둘러싸고 있습니다. 이런 도시는 흔치 않습니다. 얼마든지 쾌적한 환경을 유지할 수 있다고 봅니다.

 

▲ 개발제한구역 해제는 대통령선거와 지방선거에서도 모두 공약한 사항입니다. 따라서 지난 양대 선거에서 당선된 대통령, 도지사, 시장이 공약을 이행하려고 노력하고 있을텐데 굳이 개발제한구역 해제 여론을 조성하고 나선 배경이 있을까요?

 

대통령과 도지사, 시장께서 개발제한구역 해제를 공약으로 제시해 준 데 대해서는 매우 감사하게 생각하고 있습니다. 또 반드시 공약을 이행해 주실 것으로 믿고 있습니다.

 

하지만 선거철만 되면 개발제한구역 해제해주겠다고 공약해놓고 당선되고 나면 추진이 안 된 것이 한 두 번이 아니었습니다. 이번에는 해제 되겠지 하면서 기대했다가 역시나 하는 결과를 보면서 과거와는 좀 다르게 공약을 실천하는 모습을 보여줬으면 하는 마음이 간절하기 때문에 타당성과 정당성을 시민들과 정치인 모두가 더 공감해주기를 바라는 마음입니다.

 

대부분의 개발제한구역 토지소유주는 선대부터 농사를 짓거나 산을 일궈온 원주민이고 그 후손들입니다. 투기꾼이 아니라는 것입니다. 10월 31일 날 창원시의회에서 개발제한구역을 해제해 달라는 대정부 건의안을 제출하기로 한 것도 이 때문이라는 점을 말씀드립니다.

지난 5월 17일날 저희 연합회가 창원시청에서 기자회견을 갖고 대통령 공약 이행을 촉구한 바 있습니다. 11월 중에도 기자회견을 갖고 개발제한구역 해제 공약 이행을 거듭 촉구할 계획입니다. 또 조직화돼 있는 전국의 개발제한구역 주민들이 국토부를 상대로 할 수 있는 모든 행동을 할 예정입니다. 국회 상임위에서 공청회도 준비하고 있고, 국토부 토론회도 준비하고 있습니다.
